Background

In the 21st century, the Sustainable Development Goals (SDGs) lie at the core of the work of the United Nations. In this era of contemporary challenges of incredible magnitudes, diplomacy necessitates a practice that acknowledges, at the very least, a sustainable lens.

Development and Diplomacy are two fields that need each other to fulfill their goals. In this respect, UNITAR and the University for Peace (UPEACE) partnered to launch the Master of Arts in Development Studies and Diplomacy.

Forced Migration and Human Rights (1 March – 11 April, 2023)

This course is also offered as part of the Professional Development Diploma on Human Rights and Forced Displacement.

Course Description
This course introduces participants to the diverse, yet interlinked, issues related to the trans-boundary movement of people and how this affects human rights. It starts off by exploring the notion of ‘forced migration’, and distinguishing it from various other notions that are used to refer to the phenomenon of trans-boundary movement of people. In particular, it looks at how different people have different access to other states. Is there a right to be allowed into an other state? If so, under what conditions? The course then moves on to look at the specific regimes protecting, in varying degrees, different groups of vulnerable people. First, it gives an overview of the international law of refugee protection. Second, it looks at how human rights apply, or not, in the case of undocumented migrants. Third, it covers the protection of victims of human trafficking and the policies in place against the smuggling of people. Fourth, it considers whether migrants in general are entitled to enjoy specific social rights. Finally, it takes a closer look at the human rights dimension of border control, in particular in cases where people die in their attempts to reach the countries of their destination.

The course is designed both as a stand-alone specialized course on Forced Migration and its human rights linkages, but also as a key course of the Diploma in Human Rights and Forced Displacement.

The course is intended for staff members of civil society organizations and (inter)governmental organizations involved in forced migration and human rights issues, including human trafficking and smuggling, protection of refugees and stateless persons, immigration, protection of internally displaced persons etc. The course is also intended for staff members of (international) development agencies, academics and others interested in the aforesaid areas. (Post)Graduate students with specific research interests in these areas are also encouraged to apply. Candidates should have a good written command of English and have high competence and comfort with computer and Internet use.

About the Instructor
Dr. Juan M. Amaya-Castro, resident Professor of International Law at Universidad de los Andes (Bogota, Colombia) studied international legal studies at Leiden University in the Netherlands, and defended his Ph.D. dissertation (on Human Rights and the Critiques of the Public-Private Distinction) at the Free University of Amsterdam, where he was also a Post-Doctoral Researcher in the field of migration and law. Prior to his current position, he was an Associate Professor at the University for Peace in the International Law Department, where, among other courses, he also taught migration law. He has taught at Utrecht University and at Erasmus University Rotterdam and was a visiting researcher and Fulbright Scholar at Harvard Law School. He has published on various aspects of international law and human rights and is currently also on the Board of Consultants of SUR—Revista Internacional de Derechos Humanos/International Journal on Human Rights and in the Editorial Board of Inter-American & European Human Rights Journal.

Development and Human Rights (15 March – 25 April, 2023)

Course Description

This certificate course offered by the Human Rights Center of the University for Peace introduces participants to the major themes and debates concerning the relationship between human rights and development. The course begins with an examination of the different conceptions of ‘development’, including its evolution in theory, policy and practice, and its linkages with human rights. Participants analyze the concept of human right to development, which treats development itself as a human right and not just a process which leads to improvement in human rights. The doctrinal and policy implications of adopting a ‘human rights based approach to development’, and the related ‘right to development framework’, are discussed along with what such approaches mean, and what are the tools to implement them in the field. Participants will also explore the new streams of critique that have enabled a confluence as well as a questioning of the human rights-development linkages. These include a critical analysis of the successes and failures of the UN Millennium Development Goals from a human rights perspective, and the implications for the new post-2015 Sustainable Development Goals. The role of strategic litigation in achieving the right to development, whether using that terminology or not, is then looked at with the help of case studies from around the world. Impacts of big projects on indigenous communities is specifically inquired into. In the latter part of the course, selected current issues in the human rights-development interface that are salient from a policy perspective will be examined, including the role of trade, finance, investment, development aid, and aid for trade.

The course is based on a dynamic pedagogy including reading materials, video clips, case studies, and interactive webinars with the instructor.

About the Instructor

Dr. Mihir Kanade (India) is Director of the Human Rights Centre of the University for Peace (established by the UN General Assembly). He is the Academic Director of UPEACE and the Head of its Department of International Law. He is also an adjunct faculty at Universidad Alfonso X El Sabio (Spain), Cheikh Anta Diop University (Senegal), Long Island University (LIU Global Centre in Costa Rica), and Universidad de Los Andes (Colombia). Dr. Kanade serves as the academic co-coordinator of the LLM programme in Transnational Crime and Justice offered at the United Nations Interregional Crime and Justice Research Institute, Turin, Italy. He also serves on the International Advisory Board of the International Bar Association on the topic of Business and Human Rights. Dr. Kanade currently serves as an independent expert of the United Nations Human Rights Council on the Expert Mechanism on the Right to Development. Dr. Kanade co-leads an e-learning project in partnership with the UN Office of the High Commissioner for Human Rights and UNU-IIGH for training UN staff and diplomats of permanent missions of States on operationalizing the Right to Development in Implementation of the SDGs. He also chairs the drafting group of international experts appointed by the OHCHR for preparing a legally binding instrument on the right to development. His principal area of academic research and study is the interface between globalization, governance, public international law and human rights, covering several themes including trade, business and investment, sustainable development, forced displacement of people, indigenous peoples’ rights, public health, amongst others. He conducts several trainings for staff of intergovernmental, governmental and non-governmental organizations, as well as professionals, in the field of international law and human rights. Prior to academia, Dr. Kanade practiced for several years as a lawyer at the Bombay High Court (Nagpur and Bombay benches) and at the Supreme Court of India. He holds a LL.B from Nagpur University (India) and a Master degree and Doctorate from UPEACE.

The Human Rights Centre of the United Nations mandated University for Peace is accepting applications for its Professional Development Diploma in Sustainable Development and Human Rights, courses for which can be taken entirely online. As the name suggests, this programme focuses on the human rights dimensions of sustainable development, with a major thrust on the implementation of the Sustainable Development Goals through human rights based approaches (HRBA). This Diploma, aimed at professionals seeking training for career development, can be obtained upon successful completion of five of the six online courses offered in the programme. Enrollments are open on a rolling basis and participants can join the programme at the beginning of any of the following six courses:

  1. Development and Human Rights: 13 March – 23 April, 2024
  2. Business, Human Rights, and Development: 8 May – 18 June, 2024
  3. Child Rights and Development: 10 July – 20 August, 2024
  4. Environment, Development, and Human Rights: 04 September – 15 October, 2024
  5. Gender, Development, and Human Rights: 30 October – 10 December, 2024
  6. Indigenous Peoples’ Rights and Development: 08 January – 18 February 2025

European and International Human Rights Standards in Conflicts and Disasters (EIHRSCaD)

Course description

In recent years, the impact of natural and technological disasters, as well as of other emergencies, has been constantly on the rise, both within and outside the EU. The recent COVID-19 pandemic is the most evident example of this trend. At the same time, Europe is once again experiencing the devastating effects of armed conflicts within its borders.

Looking at these phenomena through a legal lens, it is widely acknowledged that conflicts and disasters heavily impact the enjoyment of the human rights of the affected communities. Humanitarian organizations insist that human rights principles should be more thoroughly integrated into conflict and disaster management policies in order to strengthen prevention, response, recovery, and accountability, while increasing the protection of the affected individuals and communities. However, efforts to disseminate human rights standards applicable in conflict and disaster settings have been limited, including in Europe. The intensive course on European and International Human Rights Standards in Conflicts and Disasters (EIHRSCaD) aims at addressing these gaps.

Training objectives

• Provide participants with a sound knowledge of the legal frameworks and principal actors relevant to humanitarian assistance activities in conflict and/or disaster settings, and of the role of human rights in the prevention and response to natural and technological disasters, as well as to armed conflicts.

• Raise awareness of the critical role of human rights in conflict and disaster settings, and therefore favour a more human rights-sensitive approach to their management.

• Offer a solid understanding of the specific needs of vulnerable groups affected by conflicts and disasters

Activities

The Course is divided into 5 sub-modules, one for each day of classes:

- Introduction to International Human Rights Law (IHRL), International Humanitarian Law (IHL) and International Disaster Law

- Actors in Humanitarian Assistance and Disaster Management

- Protection Issues

- Applying Human Rights in Disasters and Armed Conflicts

- Human Rights, Disaster Prevention, and the Repression of International Crimes

Teaching methods

The teaching methodology will be characterized by a combination of frontal lecturing and more interactive training techniques (case study solving, etc.).

Participants will have access to online resources ahead of the sessions to favour their active participation during classes and improve the learning experience.

Target audience

The course is intended for graduate and post-graduate students, research fellows and other academics, practitioners working in humanitarian assistance or for national and international organizations, NGOs and other actors active in this field (ICRC, IFRC, national Red Cross and Red Crescent Societies, etc.). Applicants must have a sound working knowledge of English.

Certificate

Participants will be required to pass a final exam in order to obtain 2 university credits (ECTS). Participants attending at least 80% of the classes will be anyhow awarded a certificate of attendance

EUMA Workshop: Cross-border humanitarian assistance: Legal and Institutional Aspects

Civil protection systems in Europe are grappling with an increasing number of complex disasters and crises. In recent decades, this situation has been exacerbated by environmental degradation, climate change, demographic shifts, and geopolitical changes. The availability of highly qualified human resources is crucial for anticipating, preparing, managing, and recovering from these events. This underscores the need to establish an innovative, high-level, and tailor-made postgraduate Master’s programme on disaster risk and crisis management.

The EUMA project (Creating a EUropean Higher Education Network for MAster’s Programmes in Disaster Risk Management) has received funding from DG ECHO (European Commission) to address this gap. Managed by a consortium of seven universities and coordinated by the University of Vienna, EUMA aims to enhance the skills and knowledge of individual staff members of civil protection authorities and disaster managers in the non-profit and private sectors. To achieve this goal, various practical activities, including a series of workshops, will be organized.

The inaugural workshop of the project is scheduled for 11 and 12 April 2024 at the Sant’Anna School of Advanced Studies in Pisa. It will focus on the legal and institutional aspects of cross-border humanitarian assistance. Distinguished experts will present on selected topics and then lead group discussions aimed at assessing the presentations' relevance to real-world scenarios. The outcomes of these discussions will be incorporated into the curriculum of a new postgraduate Master’s programme on disaster risk and crisis management.

The workshop is open to a maximum of 20/25 participants, with some positions reserved for members of partner institutions. The remaining participants will be selected through this competitive call for participation. Practitioners and researchers in disaster management and related fields are the primary target audience. Participants will be offered a two-night stay in Pisa. A light lunch, a social dinner, and coffee breaks will be provided during the one-and-a-half days of the workshop. Online participation will also be available.
